Terms and Conditions

This Terms and Conditions of Use Agreement (hereafter “Usage Agreement”) is a binding contract between you or the company you are acting on behalf of (hereafter either, “You” or “Your”) and Hire Red, LLC (hereafter “Hire Red”) governing Your use of www.hirered.com (hereafter the “Website”) and Hire Red’s services.

You are contractually bound by the terms and conditions set forth in this Usage Agreement. Should You not agree with any of the terms and conditions stated in this Usage Agreement, do not use the Website or any associated services.

Users of the Website who are signed up as either job seekers or employers (hereafter “Users”) must be 18 years of age or older. By using the Website, You represent and warrant that You are of legal age to form a binding contract with Hire Red and meet all of the foregoing eligibility requirements. If You do not meet all of these requirements, You must not access or use the Website.

Postings and Submissions

The Website makes no guarantees as to the level of success a User may achieve by using the Website or its services. You are not entitled to any refund, rebate, or retribution for usage that You deem to be unsuccessful.

Hire Red makes no guarantee that Your posting(s) will be accessible for the entire term of its listing. Hire Red may provide You with the option to allow Your posting to be syndicated to external job boards if You choose to do so. Hire Red is not responsible for any temporary outages caused by computer outages, software failure and other technical or non-technical issues.

No party may upload any offensive or harmful items or hyperlinks to offensive or harmful materials. Hire Red reserves the right to define “offensive or harmful materials” on a case-by-case basis. No items may be uploaded that are designed to damage the systems or designed to crack the system or extract protected data.

Users must not post any job requirement or description that:

  • Disqualifies any applicant on the basis of race, color, religion, sex (including pregnancy and related conditions, gender identity, and sexual orientation), national origin, age (40 or older), disability or genetic information.
  • Shows a preference for, or discourages anyone from applying for a job because of their race, color, religion, sex (including gender identity, sexual orientation, and pregnancy), national origin, age (40 or older), disability or genetic information. The only exception to this rule is the rare instance when it is reasonably necessary to fill a particular position with a person of a particular sex, religion, or national origin to carry out a particular job function in the normal operation of the User’s business.

Hire Red reserves the right to remove any posting that violates this Usage Agreement.

Changes to the Website

Hire Red is not obligated to update the Website’s content in real time. The content on the Website may be out of date at any given time.

Subscriptions

Subscriptions purchased by Users set up as employers on the Website are subject to the following:

Monthly: Monthly subscriptions are billed on the date the subscription starts (hereafter “Subscription Date”). Monthly subscriptions are subject to a monthly subscription fee and automatically renew one month after the Subscription Date on a month-to-month basis, until terminated in writing by the User. Monthly subscriptions may be canceled at any time. Once paid, monthly subscriptions are non-refundable. No refunds will be provided for early termination.

Geographic Restrictions

Hire Red provides the Website for use only by persons located in the United States. Hire Red makes no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If You access the Website from outside the United States, You do so on Your own initiative and are responsible for compliance with local laws.

Security

You may not access, collect, record, alter or interfere with account data that does not belong to You. Any attempts or successes at violating another User’s data or privacy results in a breach of this Usage Agreement and may result in criminal or civil proceedings.

Specific Prohibited Uses

The Website or its services may not be used for any illegal or unlawful purposes. Hire Red reserves the right to terminate usage by any party that Hire Red deems illegal or unlawful or otherwise deems questionable.

No party may enter data that is knowingly inaccurate, incomplete, or false.

No party may enter data that does not belong to them. You may not enter data for another User. This includes, but is not limited to, the listing of job opportunities, job seeker profiles, or job applications. You may not post job openings that are not for Your organization. The only exception to this is if You are an ad agency, recruitment firm, or another third-party recruitment service, with permission to post on another organization’s behalf.

No party may use Hire Red’s services with the intent of hurting, damaging, destroying, or otherwise infringing on the stability and usefulness of Hire Red’s services. No party may maintain an excessive amount of data on Hire Red servers or upload anything that may cause excessive strain on Hire Red systems and networks.

No party may use the services available on the Website for any purpose other than their intended uses. This includes, but is not limited to, the practice of posting openings that do not specifically exist for the purpose of collecting resumes, job seeker profiles, or other data from Hire Red’s Users. This practice is explicitly restricted and may result in cancellation of Your posting and removal of Your usage rights.

No party can distribute what Hire Red defines as protected materials to any third party. This may include contact data, passwords, discounts, etc. This includes the sharing of protected data with other site Users. No party may utilize data from the Website in an attempt to bypass the Website’s security and extract protected data from outside sources.

Hire Red reserves the right to alter, edit, or remove any data, profiles, or job postings.

No party may aggregate, package, spider, collect, or display any of the content on this site without the express written consent of Hire Red.

Copyrights and Trademarks

Trademarks and trade dress belonging to Hire Red or affiliated hiring organizations may appear on the site or be accessible through Hire Red. The fact that Hire Red has permitted You access to the Website does not constitute authorization to reproduce Hire Red or any other trademarks or trade dress for any other purpose.

By submitting any material to Hire Red, You are granting Hire Red a non-exclusive, royalty free, license to use, reproduce, display, distribute, modify and create derivative works from such material and market that You were the author of such material. Such submission of material includes, but are not limited to, posting a job or employer profile, posting a resume or job seeker profile, or sending Hire Red an email.

Disclaimers and Limitations of Warranties

Hire Red makes no guarantees as to the accuracy or truthfulness of any data posted on the Website. Any damage You incur by Your reliance upon this information is not the responsibility of Hire Red or its affiliates or partners. By using Hire Red, You assume all responsibility for and risk arising from Your use of and reliance upon the contents of the Website.

References and links to products, services, and companies belonging to third parties are provided for Your convenience and do not represent an endorsement by Hire Red of such products, services, or organizations. Materials accessible from or added to the Website by third parties, including, but not limited to, job listings, job seeker profiles, employer profiles, or messages between employers and job seekers, are strictly the responsibility of the third party who added such materials or made them accessible. Hire Red reserves the right to monitor third-party materials or discussions and to remove materials that Hire Red believes are inappropriate. Hire Red neither endorses nor undertakes to control, monitor, edit or assume responsibility for any such third-party material.

You assume all liabilities and risks associated with Your interaction with individuals You come into contact with through the usage of the services accessible through Hire Red. Hire Red does not guarantee that every User is who they claim to be. Hire Red make no guarantees as to the legitimacy or accuracy of any job postings, resumes, profile or any type of postings through the Website. Therefore, You agree to release Hire Red and their respective affiliates and partners from any damages or liability arising out of Your usage of Hire Red, or its services.

Hire Red and its contents are provided “as is.” Hire Red disclaims all warranties, express and implied, including the implied warranties of merchantability and of fitness for a particular purpose with respect to any information contained on, accessible through or derived by You from Hire Red and with respect to any products or services purchased by You through the Website. Hire Red disclaims any and all liability to you arising out of interruption or damage to Your computer system or software as the result of accessing or otherwise using Hire Red. Hire Red neither warrants nor represents that the services or information available through the Website will enable You to achieve any particular result or outcome, legal, economic, educational, or otherwise. Hire Red will not be liable for any incidental, indirect, consequential, or special damages of any kind, including lost revenues, lost profits, or loss of data arising out of Your use of this site. The maximum liability of Hire Red to any User is limited to the amount paid to Hire Red by such User during the twelve (12) month period prior to the date of any claim for damages.

Termination of Hire red and Website access

Hire Red reserves the right to change the contents of the Website or to discontinue it at any time. Hire Red reserves the right to deny access to the site to any person Hire Red believes is using Hire Red for any unlawful or unauthorized purpose or in a manner that may harm Hire Red or any other third party.
